Currently, North Dakota code N.D.C.C. § 32-03-09.1. prohibits diminished value compensation. Accident victims in North Dakota are limited to the cost of repairs and loss of use.

Statutory Language: The measure of damages for injury to property is presumed to be the reasonable cost of necessary repairs and the reasonable value of loss of use, unless restoration is impracticable. In such cases, damages are based on the difference in market value before and after the injury, plus loss of use during replacement.
Loss of Use Exception: Restoration is deemed impracticable when costs and loss of use exceed the property’s post-injury market value reduction.
Statutory Recovery: The statute permits recovery for the cost of repair and loss of use, but not for diminished value when repairs are elected.
