Welcome to SnapClaim! These Terms & Conditions ("Terms") govern your access to and use of SnapClaim’s website, mobile apps, tools, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you represent an organization, you and your organization acknowledge and agree that you have authority and obligation to these Terms on its behalf. Please read them carefully.
Eligibility & Account Requirements
- Minimum Age and Capacity: You must be at least 18 years old and legally capable of entering binding agreements in your jurisdiction.
- Registration and Information: You agree to provide accurate, current, and complete registration information and to update it promptly when it changes.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect any unauthorized use.
User Content & Data
- Accuracy & Legality: All information, documents, claims, or materials you submit (“User Content”) must be truthful, accurate, and lawful.
- License Grant: By submitting User Content, you grant SnapClaim a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display the content, and to incorporate it into other works, for purposes of operating, promoting, or improving the Service.
- Privacy: Our Privacy Policy outlines how we collect, use, store, and share your data. It’s incorporated into these Terms by reference.
Acceptable Use & Prohibited Conduct
You agree not to:
- Use the Service for illegal activities, including fraud, money laundering, or identity theft.
- Infringe any intellectual property, privacy, or other rights.
- Upload malicious software, viruses, or harmful code.
- Attempt to circumvent security features or tamper with the Service.
- Harvest or scrape data from the Service.
- Send spam or unsolicited communications.
- Misrepresent your identity or affiliations.
- Use the Service to publicly share sensitive personal data or otherwise harm others.
Claims Handling; Disclaimers
- No Guarantees: SnapClaim does not guarantee the acceptance, success, or outcome of any claim or submission.
- Verification & Review: We may review, verify, edit, reject, or remove any submission at our sole discretion.
- Limited Scope: SnapClaim is not an insurer, lawyer, or private investigator. We do not provide legal, insurance, or financial advice.
- “As-Is” Basis: All aspects of the Service are provided “AS IS” and “AS AVAILABLE”. SnapClaim expressly disclaims all warranties—including implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
Fees & Payments
- Price Disclosure: Any fees for using premium features or add-on services will be clearly disclosed before purchase.
- Secure Processing: Payments are processed through third-party payment processors.
- No Refunds: Unless otherwise agreed in writing, all fees are non‑refundable.
- Taxes: You are responsible for any taxes associated with your purchases.
Intellectual Property Rights
- Ownership: All content, software, images, trademarks, and logos on the Service are owned by or licensed to SnapClaim.
- Limited License to Users: You are granted a non‑exclusive, non‑transferable, revocable license to use the Service only for your personal or internal business use.
- Feedback: You may submit feedback. We may use and disclose it for any purpose without obligation to you.
Limitation of Liability
To the maximum extent permitted by law:
- Neither SnapClaim nor its affiliates, officers, employees, agents, or licensors will be liable for any indirect, special, incidental, consequential, or punitive damages.
- We are not liable for loss of profits, data, business interruption, or third‑party claims.
- Our aggregate liability for any claims related to the Service is limited to the greater of:
- The total fees paid by you to SnapClaim during the 12 months before the claim; or
- USD $100.
Indemnification
You agree to indemnify, defend, and hold harmless SnapClaim and its affiliates, officers, directors, employees, agents, contractors, successors, and assigns from any third-party claims, penalties, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from:
- Your breach of these Terms,
- Your use of the Service, or
- Your violation of any law or the rights of others.
Modification; Suspension; Termination
- SnapClaim may change, suspend, or discontinue the Service (or any part of it), or modify these Terms at any time without liability.
- Revised Terms will be posted on the Service with a new “Last updated” date. Continued use after posting signifies acceptance.
- If you don’t agree with any changes, you must stop using the Service.
- SnapClaim may suspend or terminate your access at any time, for any reason, including if you violate these Terms.
Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.
- Any dispute not resolved informally within 60 days after written notice will be resolved by binding arbitration under the rules of the American Arbitration Association, held in Delaware, before a single arbitrator.
- You and SnapClaim waive the right to jury trials, class actions, or multi-party claims.
Third‑Party Integrations & Services
- The Service may interface with third-party services (e.g., payment gateways, APIs). These are governed by their own terms and privacy policies.
- SnapClaim is not responsible for their operation, availability, or quality.
Export Compliance & Sanctions
- You agree not to use the Service in violation of any applicable export laws, economic sanctions, or trade regulations.
Severability; Waiver; Assignment
- Severability: If any provision is found invalid, the remainder of the Terms remains in effect.
- Waiver: SnapClaim’s failure to enforce any right is not a waiver of that right.
- Assignment: SnapClaim may assign these Terms or its rights at any time without notice. You may not assign your rights without SnapClaim’s consent.
